Grounds for Divorce in California |

"Grounds for divorce" are the legal reasons for a divorce. California recognizes two grounds for divorce: "irreconcilable differences" and "incurable insanity." Not surprisingly, "irreconcilable differences" is the much more common reason given. California is considered a "no-fault" state for divorce. "Irreconcilable differences" are defined as "those grounds which are determined by the court to be substantial reasons for not continuing the marriage and which make it appear that the marriage should be dissolved."
A divorce in California may also be based on the grounds of incurable insanity. To do so requires sufficient legal proof, typically including medical or psychiatric testimony from a professional (such as a psychiatrist), that the spouse is incurably insane. Proof is also required that the spouse was incurably insane at the time that the divorce was filed.
Regardless of the grounds, the divorce petition must itself state the grounds upon which the divorce is to be granted. The petition must substantiate the grounds with evidence or testimony.
